I've re-tested this issue with DisplayFusion 4.1 Beta 10 and the Windows 8 Release Preview, and it seems to be all fixed up.

Looks like the taskbar in 3.5 Beta 8 indeed stays on top of full screen apps. We'll get it fixed up as soon as possible.
