To kill the window I have to move the mouse over the diffmerge dialog. If it's behind another window I can move the mouse without killing it. Likewise if its restored and sized to only cover the top part of the screen I can move the mouse around the bottom of the monitor without anything happening. In both cases it dies as soon as the mouse moves over it.

I've got almost the same results as you when the DiffMerge window isn't minimized. For me, when I try to close it from the preview, it stays open as long as I don't move the mouse. As soon as I move the mouse after closing it from the preview, DiffMerge closes.

I just tried that test sequence and had it close; but if I skip the minimize step it remains open. Diffmerge closes correctly if I launch it from the start menu, but don't do a comparison between two files.
